Partner Bill Caldarelli Obtains Summary Adjudication For Client In Breach of Contract Matter

Motion For Summary Adjudication Granted In Its Entirety

Partner Bill Caldarelli successfully obtained summary adjudication invalidating numerous anti-competitive contractual provisions under California Business & Professions Code section 16600.  CHPL represented Salvatore Mendoza in an action brought by Mr. Mendoza’s former employer in which ProTec alleged that Mr. Mendoza was violating certain non-solicitation and non-competition provisions in his employment agreement with his former employer.  Mr. Caldarelli filed a motion challenging the enforceability and validity of the clauses under Business & Professions Code section 16600.  The motion also challenged the enforceability of a No-Hire clause in Mr. Mendoza’s former employer’s customer contracts which purported to prohibit the company’s customers from doing business with its former employees, such as Mr. Mendoza.  The motion was granted in its entirety, with each of the challenged non-competition, non-solicitation, and no-hire provisions found to be in violation of California law and unenforceable.

Caitlin Macker Coaches UCSD Collegiate Mock Trial Team to National Championships

CHPL Attorney’s Mock Trial Team Ranks in National Competition – 4/7/19

After being awarded All Region Attorney as a collegiate mock trial advocate in 2011, CHPL’s own Caitlin Macker returned to the national collegiate mock trial tournament scene this weekend, as a coach.   In just three years of volunteer coaching USCD’s collegiate mock trial team, Caitlin guided three UCSD teams to qualify for the American Mock Trial Association’s Championship Series.  With CHPL’s feedback and Caitlin’s boundless mentorship, one of those teams went on to place 10th at the National Championship Tournament, competing against the top 48 teams in the nation.  Caitlin and her students dedicated hundreds of hours over the course of the school year to achieve these successes. Congratulations to the UCSD students and their coach Caitlin Macker!

Marisa Janine-Page Secures Complete Defense Victory for Client After Two Week Jury Trial

CHPL’s Client Prevailed on All Nine Causes of Action Alleged Against It in Employment Discrimination Case

Marisa Janine-Page’s client was sued by an ex-employee for gender discrimination, disability discrimination, interference with the California Family Rights Act and the Family Medical Leave Act, and intentional infliction of emotional distress, among other causes of action.  After almost a year-and-a-half of litigation, the parties went to trial in Los Angeles Superior Court.  After two weeks of trial, the jury, after only a few hours of deliberation, returned a complete defense verdict on all causes of action in Ms. Janine-Page’s client’s favor.  Ms. Janine-Page later brought a successful motion for sanctions under Code of Civil Procedure section 128.5 arising from plaintiff’s counsel’s bad faith, frivolous litigation tactics.  The firm is pleased by the favorable result obtained for the client, and congratulates Ms. Janine-Page on her zealous advocacy.

Firm Founder and Partner Bill Caldarelli Honored as a Super Lawyer for the 10th Year in a Row

Every year, five percent of San Diego attorneys are selected for inclusion in Super Lawyers based on peer evaluations and third party research evaluating the attorneys.  For the fifth year in a row, Bill Caldarelli, Lee Hejmanowski, Marisa Janine-Page, and Jack Leer were recognized as Super Lawyers in San Diego County.  Both Lee Hejmanowski and Jack Leer were recognized on the Super Lawyers “Top 50” List in San Diego.

This year, Super Lawyers recognized, for the first time, those attorneys named as Super Lawyers for ten years in a row.  Firm founder and partner, Bill Caldarelli, a constant on the Super Lawyers list, was recognized as 10-year honoree.   Attorney David Lichtenstein was recognized as a Super Lawyers “Rising Star” for the third year in a row.

Every year the San Diego Business Journal publishes its annual “Best of the Bar” list.  This year, the San Diego Business Journal’s third annual list includes attorneys Bill Caldarelli, Marisa Janine-Page, and David Lichtenstein.  The “Best of the Bar” honorees are selected by their peers as the most outstanding in their field.  Mr. Caldarelli’s practice includes business, real estate, and intellectual property litigation. Ms. Janine-Page’s practice includes business, real estate, and employment litigation.  Mr. Lichtenstein’s practice includes business and real estate litigation.

All Four Partners Recognized as 2016 San Diego Super Lawyers in Business Litigation
