Attorneys Bill Caldarelli and Jack Leer Recognized on the “Top 50” List
Super Lawyers, one of the premier attorney rating publications in the country, published its annual list of “Super Lawyers” for San Diego County which includes all six CHPL Partners. Bill Caldarelli and Jack Leer were recognized on the Super Lawyers “Top 50” List in San Diego in the Business Litigation practice area. Jack’s been on the “Top 50” List since 2016 and Bill since 2018. Lee Hejmanowski and Ben West were also named “Super Lawyers” in the Business Litigation practice area. Marisa Janine-Page was named a “Super Lawyer” in the Appellate practice area. David Lichtenstein was named a Super Lawyers “Rising Star,” a designation afforded to attorneys under the age of 40, in the Business Litigation practice area for the sixth year in a row.

CHPL Elevates Two New Partners – Ben West & David Lichtenstein

Ben, a graduate of BYU’s J. Reuben Clark Law School, joined CHPL in 2012. Ben represents companies and individuals in all aspects of commercial litigation, focusing on intellectual property and real estate/construction disputes. Super Lawyers has repeatedly recognized Ben for his work in business litigation.
David, a graduate of the University of Iowa College of Law, joined CHPL in 2014. David represents clients in real estate litigation and complex business disputes. Super Lawyers awarded David the “Rising Star” title annually since 2015 and San Diego Business Journal named him “Best of the Bar” in 2016.

Partner Bill Caldarelli Obtains Summary Adjudication For Client In Breach of Contract Matter
Motion For Summary Adjudication Granted In Its Entirety
Partner Bill Caldarelli successfully obtained summary adjudication invalidating numerous anti-competitive contractual provisions under California Business & Professions Code section 16600. CHPL represented Salvatore Mendoza in an action brought by Mr. Mendoza’s former employer in which ProTec alleged that Mr. Mendoza was violating certain non-solicitation and non-competition provisions in his employment agreement with his former employer. Mr. Caldarelli filed a motion challenging the enforceability and validity of the clauses under Business & Professions Code section 16600. The motion also challenged the enforceability of a No-Hire clause in Mr. Mendoza’s former employer’s customer contracts which purported to prohibit the company’s customers from doing business with its former employees, such as Mr. Mendoza. The motion was granted in its entirety, with each of the challenged non-competition, non-solicitation, and no-hire provisions found to be in violation of California law and unenforceable.
